2011 GROUP DEPOSIT AND CANCELLATION POLICY

RESERVATIONS AND PAYMENTS Confirmed reservations require a non-refundable deposit of $300.00 per person within 30-days of booking. Final payment is due 60 days before departure. Documents will be sent 14-21 days prior to departure.
CANCELLATION All cancellations must be made in writing. The date of the cancellation shall be, the date that written notice is received by FOS Tours. For written cancellations received within 60 days of departure, the following cancellation fees will also apply: 59 – 45 days, 50% of the tour price; 44 – 30 days prior to departure 75% of tour cost; 29 – 0 days or No Show 100% of the tour price will be retained as penalty. No refunds will be made on any unused services of the tour.  45 days prior to departure – FOS Tours must receive each traveler’s name as it appears in their passport, along with their date of birth, passport number, date passport expires and citizenship, otherwise the airline will note be issued. Any corrections to a name given to FOS Tours incorrectly will be charged $300 to name correction.   We strongly recommend that a copy of your passport, pages 1 and 2 be sent or emailed to FOS Tours.
AIR FLIGHTS group flight booking are ticketed 35 days prior to departure, and once ticketed are non-refundable and non-transferable.
OPERATOR CANCELLATION Tour price quoted for the tour program is based on a minimum of 30 passengers booking and traveling together on the tour.  FOS Tours & Travel reserves the right to cancel any tour prior to departure if a minimum of participants is not met or if any other circumstances so warrants. Should the minimum number of 30 tour members not be reached, the right is reserved to increase the tour cost accordingly.  Payment will be refunded, less any cancellation penalties incur by the airline and without further obligation on the part of the operator.
INSURANCE Travel insurance, such as trip and cancellation, lost baggage, health insurance for medical emergencies is included in your tour price.
BAGGAGE On transatlantic flights, baggage allowance is one checked piece, with a weight limit of 50 pounds, and combined overall dimensions not to exceed 106 inches. On inter-European flights, weight is limited to 40 pounds or 20 kilos. Carry-on luggage cannot exceed 45 inches. FOS Tours recommends one piece of check-in luggage and a carry-on bag. FOS Tours is not responsible for loss, delayed, theft, or damage of luggage. Baggage insurance is strongly recommended.
HOTELS Accommodations are based on double occupancy rooms with private facilities in first class hotels. A limited number of single rooms are available at the supplement quoted and should be requested at the time of booking.
ITINERARY VARIATIONS These tours are planned a year or more in advance. Between planning time and the actual tour operation, FOS Tours constantly strives to improve each itinerary and all features to your advantage, convenience and enjoyment. During local or national holidays’ abroad, certain features, such as museums, sightseeing tours and shopping may be limited or unavailable. In such instances, and whenever possible, itinerary adjustments and substitutions are made to minimize inconveniences. Modifications in the day-by-day itinerary may occur, due to the local conditions and/or operational difficulties beyond our control. Also, should it be necessary local suppliers reserve the right to substitute accommodations, tours, performances, meals, etc., with those of equal or better value, with no further obligation. Prices are based on tariffs and exchange rates in effect as of October 2008. The effect of inflation, foreign currency exchange levels and increased fuel cost, labor and materials may sometimes alter the costs of our tour arrangements. We regret that we cannot simply absorb these cost increases. We reserve the right to alter our prices accordingly, whenever these cost increases and/or unfavorable fluctuations in the exchange rate of any country so warrant.
NOT INCLUDED passport fees and excess baggage fees are not included in the price of the tour. Also not included are items of a personal nature, such as telephone calls, additional food or beverage items, room service, valet or laundry service, optional activities, meals or drinks not listed as included, tipping for personal service not part of the tour, end-of-tour gratuity to tour escorts, and any other items not mentioned as included.
RESPONSIBILITY FOS Tours & Travel, Inc., hereafter called the Company, acts only on behalf of hotels, airlines, its companies, railroads, steamship lines, its owners, operators or contractors (all herein called Contractors) providing services in connection with these tours, and all coupons, exchange orders, receipts, contracts, and tickets issued by Company are issued subject to any and all tariffs, terms and conditions under which the foregoing or any such services are provided by Contractors. The airlines concerned are not to be held responsible for any act, omission or event during the time passengers are not aboard their plane or conveyance. The passenger contract in use by airlines concerned when issued shall constitute the sole contract between the airlines and purchaser of these tours and/or the passengers. In the absence of negligence on Company’s part, it is not responsible for personal injury or property damage or loss arising out of the act or negligence of any direct air carrier, hotel or other person rendering any of the services or accommodations offered herein. The tour member agrees to the foregoing, and also agrees that the Company shall not be or become liable or responsible for any loss, injury or default of any person, firm, corporation or their entity engaged to supply the same. The Company accepts no responsibility for losses or expenses due to delays or changes in air or other services, sickness, weather, strikes, hotel over-bookings, social and labor unrest, war, terrorist activities, quarantine or any other causes, actions or omissions, or conditions over which it has no control. The Company reserves the right to withdraw a tour, or refuse to accept or retain any person as a member of a tour at any time, or to make changes in the itinerary whenever, in its sole judgment, conditions warrant, or if such changes result from circumstances beyond the control of the Company, or if it deems necessary for the comfort, convenience or safety of the passengers. The tour operator and contractors reserve the right to change the itinerary at any time. Traveler assumes complete and full responsibility for, and hereby releases the Company from any duty of checking and verifying any and all passport, visa, vaccination, or entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. The payment for reservations on any tour shall constitute consent to all provisions in the Terms and Conditions published herein.
